In an important step toward strengthening labour protections in the Maldives, President ratified the Occupational Safety and Health Act (Act No. 09/2023) on January 2, 2024. The legislation, which sets nationwide standards for workplace safety and employee well-being, was passed by the People’s Majlis on December 18, 2023, during its 37th sitting of the third session.

The newly ratified law aims to create a safer and more secure work environment across all industries, aligning the Maldives with international norms on occupational safety and health (OSH). It mandates both employers and employees to adhere to practices that safeguard the physical and mental well-being of workers.

Key Provisions of the Act

The Occupational Safety and Health Act introduces a range of enforceable measures, including:

  • Employer Accountability: Employers will now face financial penalties for maintaining hazardous work environments.
  • Employee Protection: Workers injured in the line of duty are entitled to compensation, promoting justice and welfare in the workplace.
  • Regulatory Framework: The Act outlines a comprehensive policy structure to standardise safety practices across different sectors.
  • Shared Responsibility: Both employers and employees are held accountable for upholding safety protocols.

Implementation Timeline

According to the Act, the government has six months from the date of ratification to formulate and publish the necessary guidelines and policies in the Government Gazette. This timeframe is critical to ensure that all stakeholders have clear and actionable direction as they transition to compliance.

While the Act was published in the Gazette upon ratification, it will officially come into force three months later, giving organisations time to assess their current safety practices and implement the required changes.

A Progressive Step Forward

The ratification of the Occupational Safety and Health Act represents a significant shift in the Maldives’ labour landscape. It prioritises the health and safety of the workforce—an essential element for sustainable economic development. This is especially crucial in high-risk industries such as construction, tourism, fisheries, and manufacturing, where workers often face occupational hazards.

By enshrining these protections in law, the Maldivian government signals its commitment to modernising labour standards, reducing workplace accidents, and fostering a culture of safety.

As the country now prepares for the Act’s enforcement, both public and private sector employers will need to evaluate existing workplace conditions and align them with the new requirements. The Occupational Safety and Health Act provides a legal foundation for workplace safety but also lays the groundwork for a healthier, more productive workforce. Its successful implementation will depend on coordinated efforts from government bodies, employers, employees, and regulatory agencies.
